The following information comprises the agenda for the regular meeting of the Banning City Council, a joint meeting of the City Council and Banning Utility Authority, and the Banning City Council sitting in its capacity as the Banning Successor Agency Board.
Per City Council Resolution 2016-44, matters taken up by the Council before 10 p.m. may be concluded, but no new matters shall be taken up except upon a unanimous vote of the council members present and voting. Such an extension shall only be valid for one hour and each hour thereafter shall require a renewed action for the meeting to continue.

Approval of the Meeting Minutes for the August 27, 2024 City Council Meetings

 
Recommendation:

Approve the minutes of the August 27, 2024 City Council Meetings.

Receive and File Accounts Payable and Payroll Warrants Issued in the Month of July 2024

 
Recommendation:

Receive and file the warrants for period ending July 31, 2024, per California Government Code Section 37208.

Receive and File Cash and Investments Report for the Month of July 2024

 
Recommendation:

That City Council receive and file Cash and Investment Report for July 2024 on this day, September 10, 2024, in accordance with California Government Code 53646.

Accept an Easement from Tri Pointe Homes for Electric Utility Purposes on Tract Map No. 37389-1, within the Atwell Development for the Maintenance of the City-Owned Electric Distribution System

 
Recommendation:

Staff recommends that City Council accepts an easement from Tri Pointe Homes for electric utility purposes for Tract Map No. 37389-1, Lots ‘K’, ‘L’, ‘O’, ‘P’, and ‘Q’ within the Atwell Development for the maintenance of the City-owned electric distribution system.

Accept as Complete Various Improvements Related to the Atwell Specific Plan Development and Authorize the 90% Reduction of the Improvement Bonds

City Council accept as complete various improvements related to the Atwell Specific Plan Development and authorize the 90% reductions in the improvements bonds.

Consideration of the Second Reading and Adoption of Ordinance 1606, Setting Salaries for City Council

Consideration of Resolution 2024-144, In Support of Proposition 36: The Homelessness, Drug Addiction, and Theft Reduction Act

Consideration of Resolution 2024-145, Declaring Pursuant to Government Code Section 54221 That Real Property Owned by the City, Located at 646 West Ramsey Street, Banning, California (Consisting of APN 540-191-008) Is Designated As Surplus Land and Not Necessary for the City’s Use at This Time, Finding That Such Declaration Is Exempt From Environmental Review Under the California Environmental Quality Act, and Taking Related Actions

Continued Consideration of Proposed Banning Point Project, a Proposed Subdivision of Approximately 47 Gross Acres of Vacant Land into Three Parcels (Tentative Parcel Map No. 38164) and Construction of a Proposed 619,959 Square Foot Industrial Warehouse Building, Including 10,000 Square Feet of Office Space and a Combined 34,000 Square Feet of Retail/Commercial Buildings (Design Review No. 21-7008), on Real Property Located Within the Boundaries of the Sun Lakes Village North Specific Plan Area (APN: 419-140-057), and Proposed Addendum Prepared for the Project Pursuant to the California Environmental Quality Act

 
Recommendation:

Staff recommends that the City Council:

  1. Consider the Project Applicant’s request to conduct a new public hearing on the proposed Project and direct staff to notice the Project for a new public hearing; OR
  2. Consider the Project Applicant’s request to conduct a new public hearing on the Project and determine not to hold a new hearing but to continue with its consideration of, and deliberation on, the Project, and:
    1. Adopt Resolution 2024-150, approving Tentative Parcel Map No. 38164 (the subdivision of land only), denying Design Review No. 21-7008, and adopting an Addendum under the California Environmental Quality Act (CEQA) prepared for the Project; OR
    2. Adopt Resolution 2024-149, approving Tentative Parcel Map No. 38164 and Design Review No. 21-7008 (collectively, the “Project”), and adopting an Addendum under the California Environmental Quality Act (CEQA) prepared for the Project; OR
    3. Adopt Resolution 2024-151, denying Tentative Parcel Map No. 38164 and Design Review No. 21-7008, and finding the Project exempt from CEQA.
